This week the state of Oregon removed the prohibition of citizens fueling their own vehicles at gas pumps; leaving the state of New Jersey as the sole state that prohibits their citizens from pumping their own gas.  Here is an excellent article explaining how these prohibitions began in New Jersey.  But the reaction of the Oregon citizens is quite shocking.  If one was to read some of their social media comments (FaceBook link) you would see why there was a prohibition, to begin with.  After reading hundreds of, often LOL, comments I quickly realized that there are many people who have no idea as to the dangers of transferring a flammable liquid. 

The OR law took effect on 1/1/2018 and allows some gas stations in the State's 15 counties with populations under 40,000 to offer self-serve gasoline. Three counties on the Oregon Coast can now offer self-serve fueling from 6 p.m. to 6 a.m. under the same bill. 

Notwithstanding ORS 480.320, 480.330 and 480.340, and subject to subsection (3) of this section, if a filling station, service station, garage or other dispensary where Class 1 flammable liquids are dispensed at retail is located in a low-population county of eastern Oregon, the owner or operator may[, after 6 p.m. and before 6 a.m.]:

    1. Permit a person other than [the] an owner, operator or employee to use or manipulate a device for dispensing liquids into the fuel tank of a motor vehicle or other retail container;
    2. Permit the use of an installed coin-operated or self-service dispensing device for the liquids; and
    3. Allow the use of an automatic nozzle to dispense the liquids without [the] an owner, operator or employee being in the immediate vicinity of the tank or container being filled.

If the site of a dispensary described in subsection (2) of this section includes retail space providing goods or services, other than goods or services for maintaining, repairing or cleaning a motor vehicle, the dispensary shall make an owner, operator or employee available for dispensing Class 1 flammable liquids after 6 a.m. and before 6 p.m.

Notwithstanding ORS 480.320, 480.330, 480.340 and 480.345, if a nonretail facility is located in a low-population county of eastern Oregon, the owner or operator may:

    1. Permit the dispensing of Class 1 flammable liquids at retail;
    2. Permit a person other than an owner, operator, employee or nonretail customer to use or manipulate a device for dispensing liquids into the fuel tank of a motor vehicle or other retail container;
    3. Permit the use of an installed coin-operated or self-service dispensing device for the liquids; and
    4. Allow the use of an automatic nozzle to dispense the liquids without an owner, operator or employee being in the immediate vicinity of the tank or container being filled.

 

If you clicked on the article link above you saw that in the 1950's the NJ State Supreme Court ruled that self-serve gasoline was "dangerous in use."  Thus now there was a "legal precedent" that required full-service stations.  As most safety professionals could agree, safety at the pump leaves a lot to be desired!  Just this past hurricane season I shared more than a half dozen jaw-dropping photos of "citizens" transferring Class 1/Category 2 flammable liquids in ways that makes one wonder if we really have evolved!  Of course, the flip side to this debate is that the last several times I fueled up in NJ I had the opportunity to snap a few doosey's of their state-trained "attendants" doing some rather "unsafe acts" while handling Class 1/Category 2 flammable liquids.
